Welcome to Ekaki! These Terms of Use ("Terms") govern your use of the Ekaki mobile application (“App”), operated by Miles2go LLC. By accessing or using Ekaki, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use Ekaki. By using the App, you confirm that you meet this requirement.

2. Account Registration

To use Ekaki’s core features, you must create an account:

• You agree to provide accurate and complete information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for any activity under your account.
• If you suspect unauthorized use of your account, notify us immediately at support@ekaki.travel.

3. User Conduct

You agree not to:

• Post content that is abusive, threatening, obscene, defamatory, or otherwise objectionable.
• Harass, stalk, or impersonate other users.
• Share misleading, fraudulent, or illegal content.
• Upload malware, viruses, or code that harms other users or the App.
• Use the App for commercial purposes without our permission.

Enforcement:

Ekaki reserves the right to moderate, edit, or remove content that violates these terms, and to suspend or terminate users who breach them.

4. Truthfulness & Accuracy of Information

You agree to:

• Provide truthful and accurate details about yourself, including travel plans and profile information.
• Not misrepresent your identity, location, or travel plans in any way.
• Understand that inaccurate or misleading information may result in account suspension or termination.

5. Community Guidelines

We encourage respectful and inclusive interactions. You agree to:

• Be respectful in one-on-one and group messages.
• Use the platform for genuine travel-related connections.
• Report inappropriate behavior via in-app tools or to support@ekaki.travel.

6. Messaging & Groups

• Private messages and group chats are not publicly visible but may be subject to review in cases of abuse reports.
• Ekaki is not responsible for conversations or outcomes resulting from interactions with other users.

7. Safety Disclaimer for In-Person Meetups

While Ekaki helps users connect, any in-person meetups are at your own risk.
To stay safe:

• Always meet for the first time in public, well-lit places.
• Inform a trusted friend or family member of your plans.
• Arrange your own transportation so you can leave safely if needed.
• Trust your instincts — if something feels off, leave immediately.

Ekaki is not responsible or liable for any harm, dispute, loss, or injury that may occur during in-person meetings arranged through the platform.

8. Intellectual Property

All content and materials in the app (except user-generated content) are owned by or licensed to Ekaki. You may not copy, reproduce, distribute, or create derivative works without permission.

9. License to User Content

By posting content (e.g., travelogues, posts, photos), you grant Ekaki a worldwide, royalty-free, non-exclusive license to use, display, and distribute your content for the purpose of operating and promoting the App.

10. Third-Party Services

Ekaki may contain links or integrations with third-party websites or services. We are not responsible for the content, policies, or practices of any third-party service.

11. Informational Purposes Only / No Professional Advice

The information provided within Ekaki, including travel tips, recommendations, or AI-generated suggestions, is for informational purposes only.

• Ekaki does not provide professional travel, legal, medical, or safety advice.
• Users are responsible for verifying information and making their own decisions.

12. Notice / Communication

• By using Ekaki, you agree to receive important notices and updates via email, in-app notifications, or push notifications.
• It is your responsibility to keep your contact details up to date to ensure you receive such communications.
• Notices are considered delivered once sent to the most recent email address or via the app.

13. Termination

We may suspend or terminate your account without notice if:

• You violate these Terms or applicable laws.
• You engage in behavior harmful to the platform or its users. You may also delete your account at any time.

14. Disclaimer of Warranties

Ekaki is provided “as is” and “as available.” We do not guarantee that the App will be error-free, secure, or always available.

15. Limitation of Liability

To the fullest extent permitted by law, Ekaki is not liable for:

• Any indirect, incidental, or consequential damages
• Any loss of data, business, or opportunities
• Any user behavior, including travel arrangements or disputes

Use Ekaki at your own risk.

16. Modifications

We reserve the right to update or modify these Terms at any time. We’ll notify you of major changes. Continued use after updates constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
